The New Mexico Court of Appeals has ordered a new civil trial against the city of Clovis, the Clovis Police Department and three officers.
According to the Court of Appeals Opinion, the district court allowed a jury to be seated that wrongfully excluded Hispanic jurors.
The suit was filed by Juventino Hernandez after he says he was hog-tied during an arrest.
The suit claims Hernandez was given medicine at the hospital to get him to “chemically” settle down, and had a heart attack.
Hernandez died several months later from complications from the heart attack.
