Lawsuit Filed Against Clovis Daycare After Child Injured During Employee Fight

CLOVIS, NM (KAMR/KCIT) - A lawsuit has been filed against a Clovis daycare and a then employee after a child was injured during a fight between employees.

The court document states the incident happened on or about May 3.

According to attorney Eric Dixon, the video below is from inside the Future Generations Early Concepts Learning Center. He says the child's parents got the video from the Clovis Police Department.

We have blurred the video to protect the identities of the alleged victims.

A court document shows the parents are suing Future Generations and Elizabeth Parrez.

The lawsuit claims Parrez started the fight.

A manager at the daycare told us tonight Parrez no longer works there.

As you can see, the fight began on the right side of the screen and moved across the room.

When the woman was thrown to the ground, you can see the woman's leg hit at least one child.

In the suit, the family says the child was injured and needed medical attention.

It says the daycare was negligent in hiring Parrez and failing to prevent or stop a fight from breaking out inside the center.

According to the document, the family is seeking damages for physical and emotional injuries.

A search of court and jail records shows Parrez has not been criminally charged in this incident.
