AMARILLO -- At least one of the passengers of the vehicle that crashed and killed five cast and crew members of the outdoor drama TEXAS was sober but, not driving.

Toxicology results on all five people killed in the August crash show 21-year-old Eric Harrison had a blood alcohol level of .059. Just below the legal level of .08.

The others killed in the crash were all legally drunk, including the driver, 20-year-old Clinton Diaz.

In fact, toxicology results show Diaz was the drunkest.

Six members of "TEXAS" were returning from a party at the Coldwater Ranch North of Dumas when Diaz allegedly ran a stop sign and was struck by a semi-truck.

The truck driver and one of the passengers in the "TEXAS" car survived.
