"TEXAS" Crash Victim Drops Lawsuit

Timothy Marquis Johnson on Friday filed a notice of non-suit against defendants Joe Batson, the Coldwater Cattle Company and the Texas Panhandle Heritage Foundation.
AMARILLO -- The man who surivived a deadly crash that killed cast and crew members of the outdoor drama "Texas" over the summer has dropped his lawsuit.

Timothy Marquis Johnson on Friday filed a notice of non-suit against defendants Joe Batson, the Coldwater Cattle Company and the Texas Panhandle Heritage Foundation.

Johnson originally sued the trio for more than a million dollars claiming negligence on their part concerning the August crash that also injured johnson and a truck driver.

The driver of the vehicle carrying the cast and crew was legally drunk according to DPS troopers.

Investigators say Clint Diaz ran a stop sign leaving a cast party at Coldwater Ranch causing the collision with a semi-truck.
