Lubbock Agrees to Pay After Woman Falls Into Hole

LUBBOCK -- The City of Lubbock agreed to pay $88,950 last week to settle a lawsuit with Eva Montez. Sometime in 2010, the city removed a utility pole in the 300 block of Boston Avenue - leaving behind a hole that was four to five feet deep. Court records say the city did not fill in the hole, and Montez stepped into it. 

The hole was close to Jones AT&T Stadium, and Montez claimed that she was walking away from the stadium at night after a football game. She claimed she could not have seen the hole. She sued for medical bills, plus pain and suffering. 

“The City denies any liability,” official records say. 

“But [the city] is willing to settle all claims to avoid the inconvenience, distractions, uncertainties and expenses attendant to litigation and trial…” 

The City Council approved the settlement Thursday night with no public discussion.
