PORTALES -- Fabian Lopez, 23, was found guilty Wednesday of Aggravated Battery with a Deadly Weapon, a third degree felony.
In February 2011, Fabian Lopez and the victim got into an altercation at the Midway Dairy, when Lopez stabbed the victim in the leg. New Mexico State Police investigated the incident and arrested Lopez at the dairy later that same day.
Judge Quinn ordered that sentencing be held at a later date and allowed Lopez to remain free on bond. Lopez faces three years in prison, and must serve 85% of that time as the crime is classified as a serious violent offense.
District Attorney Andrea Reeb stated, “Defense Attorney Burrill argued the defendant acted in self-defense when stabbing the victim in the leg. However, the jury concluded this conduct was not reasonable under the circumstances and convicted the defendant.”
