Lawsuit Against Sunland Peanuts Put on Hold
By Aaron Langston
PORTALES -- A lawsuit filed earlier this year in a California Federal Court against Sunland Peanuts and it's CEO has been placed on hold.
The suit was filed by "Swain Creations", a chocolate maker.
They say last year's Sunland Plant Salmonella recall cost the company a million dollars after they had to recall some of their candy.
"Swain Creations" also claims Sunland took part in fraudulent business practices.
The CEO of Sunland, Jimmie Shearer, has asked the judge to hold off on proceedings against him and the company pending the company's bankruptcy filing.
The lawsuit has been held off until January 28th.
