Former Ruby Tequila's Employees Look at Options

AMARILLO - Former workers of Ruby Tequila's may be seeking legal action.

A local civil rights attorney says they way the workers were dismissed may be illegal.

Employees of both Ruby Tequila's restaurants in Amarillo found out last week they no longer had jobs when they showed up to work only to find them closed.

It's the same story for the two locations in Lubbock.

Dozens of employees are now looking for new jobs after last week's surprise closing of the two Ruby Tequila's locations.

Some people are helping in that regard, but a local attorney thinks they may have legal recourse.

Ryan Brown, a civil rights attorney, said he has received numerous calls from former employees of the restaurant asking about their options.

Many of those employees failed to receive their final paychecks which is a problem in itself.

Businesses shutting down and leaving their employees without jobs is nothing really new, but Brown said the owner of the Ruby Tequila's" franchise "Fired Up Holdings" out of Lubbock may have actually violated the "Worker Adjustment and Retraining Notification" act known as WARN.

"It's different because it's illegal," Brown told us. "There was no notification given.  They were all closed down.  These people have families to take care of.  I think they didn't even get their last paychecks from what I understand.  So, that's why it's different.  It was out of the blue and it's illegal."

Brown said they are currently researching the possibility the law was broken. It depends on the total number of employees involved and how many were part time and full time and other factors.

Brown adds that he has heard from former employees both in Amarillo and in Lubbock.

"Fired Up Holdings" is not commenting. Calls to their corporate office are answered by a machine explaining they are currently in liquidation and can only be contacted in writing.

A former employee said he saw the problems the company was having before they shut down.
