The boy's mother and her boyfriend are both charged in his death.
Yazmani Rodriguez is charged with murder in the death of Noel Vargas-Diaz, 4.
The mother, Sylvia Vargas, is accused of enabling child abuse.
According to court documents, the child suffered long term abuse.
His death last week alerted authorities to what kind of abuse he allegedly endured.
Officials say they were informed about the boy's death by doctors at the Liberal, KS hospital, about 15 miles from Turpin.
The mother allegedly told doctors Noel injured his neck when he fell in the bathtub.
Doctors called police saying the child's injuries were not consistent with a fall.
Texas county district attorney James Boring says the mother wasn't with the child when the fatal incident happened.
"Miss Vargas was apparently at work in the afternoon and evening hours of the 27th. She was contacted by Mr. Rodriguez that she needed to come home. At that point, she went home with him. And determined that the child was indeed possibly dead at that point." Boring said.
The arrest record indicates Noel endured years of severe abuse.
He allegedly had bruises all over his body as well as apparent cigarette burns.
Records show other children in the home confirmed the abuse of Noel for little things like messing up his potty training or not dressing himself properly.
Rodriguez is being held in the Texas county jail on $5 million bond.
Vargas' bail is $500,000.
She's in the Beaver county jail.
